Buying Rented Apartment Costa Del Este

Thinking about buying an apartment that already has a tenant paying rent? Panama Elite Homes is marketing a two-bedroom investment apartment at The Regent in Costa del Este, leased at $2,100 a month until April 1, 2027. The questions buyers ask about it are the right ones: does the lease survive the sale, what is the yield once costs come out, and can the purchase support residency?

A tenanted apartment is a different purchase from an empty one. You take over a contract, a tenant and a rent that someone else negotiated. This guide uses The Regent unit as a worked example to show how Panama’s lease law treats a sale, how to calculate real returns, what to check before you sign, and where this kind of property fits Panama’s residency rules as they stand in late 2026.

Quick Answer: Is a Tenanted Costa del Este Apartment a Good Investment?

In Panama, the buyer must honour the lease the seller signed, so a tenanted apartment produces rent from the day you take title. The Regent unit (95 m², $350,000, leased at $2,100 a month until April 1, 2027) shows a 7.2% gross yield. After property tax, HOA fees, management and a maintenance reserve, a realistic net yield is roughly 4.2% to 5.6% before income tax, depending on fees you should confirm. It suits investors who want long-term income in Panama City’s main corporate district without furnishing a unit or finding a tenant, and at over $200,000 it meets the Friendly Nations Visa real estate minimum. It does not meet the Qualified Investor route, which since September 2026 requires $500,000 for resale or previously leased property. The main thing to plan is the lease expiry, which falls only a few months after a typical closing.

What “Already Rented” Means When You Buy in Panama

Residential leases in Panama are governed mainly by Law 93 of 1973, administered by the Ministry of Housing (MIVIOT) through its Dirección General de Arrendamientos. Three of its rules shape a tenanted purchase.

The lease transfers with the property

Article 17 obliges the buyer of a leased property to respect the leases the seller signed, provided they comply with the law. You step into the landlord’s position: the tenant keeps the apartment on the same terms, and the rent is paid to you from the transfer date.

The contract and the deposit sit with MIVIOT

The law requires leases to be written on official forms, with a copy lodged at MIVIOT within five business days of signing. The tenant’s deposit, equal to one month’s rent, is consigned to MIVIOT rather than kept by the landlord, a rule Law 259 of 2021 reaffirmed. Before closing, confirm both steps were taken, and ask your attorney how the change of landlord is notified so the deposit is handled correctly when the tenancy ends.

Ending a tenancy is regulated

Panama’s lease law limits the grounds for ending a residential tenancy and sets procedures and notice periods, and it has been amended several times since 1973. If your plan depends on having the apartment empty by a certain date, have your lawyer review this specific contract before you sign a promise to purchase.

The Regent at a Glance

The Regent is a 55-storey residential tower in the Costa del Este Country Club complex, built and developed by Desarrollo Bahía and designed by Pinzón Lozano & Asociados, with construction running from 2014 to 2017. The complex is gated with a 24-hour security checkpoint. Residences range from about 95 m² to 205 m², and owners share a private Casa Club with pools, a gym, sports courts and children’s areas.

Costa del Este is a planned district in the Juan Díaz corregimiento, crossed by the Corredor Sur expressway that links it to the city centre and Tocumen International Airport. Our Costa del Este real estate guide covers the neighbourhood, lifestyle and price bands; this article focuses on the investment mechanics.

The unit for sale Detail
Size 95 m²
Layout 2 bedrooms, 2 bathrooms, open-plan living and dining, open kitchen, laundry area
Outdoor space Private balcony with city views
Asking price $350,000 (about $3,684 per m²)
Lease in place $2,100 per month, valid until April 1, 2027

What Comparable Regent Units Were Listing For in 2026

The figures below are asking prices and asking rents from public listings for The Regent dated February to September 2026. They are a snapshot, not an index, and asking figures are not agreed prices or signed rents.

Unit Listing date Asking Approx. per m²
2-bed, 95 m², for sale July 2026 $355,000 $3,737
3-bed, 202 m², for sale July 2026 $560,000 $2,772
3-bed, 202 m², furnished, for sale February 2026 $630,000 $3,119
2-bed, 95 m², for rent August 2026 $2,450 a month —
2-bed, 96 m², appliances only, for rent July 2026 $2,300 a month —
2-bed, 96 m², furnished, for rent April 2026 $2,300 a month —
2-bed, 106 m², furnished, for rent July 2026 $2,000 a month —

Three things stand out.

  • The price is in line with the building. At about $3,684 per m², the unit sits just below the other 95 m² two-bedroom listed at $355,000. Two-bedrooms carry a higher price per m² than the 202 m² three-bedrooms, which is normal for smaller units.
  • The rent in place is modest. $2,100 sits at the lower end of 2026 asking rents for similar two-bedrooms ($2,000 to $2,450). That points to room for a rent review at renewal, rather than a tenant paying above the market.
  • The yield is at the top of the area’s range. Our Panama rental yield analysis puts Costa del Este two-bedrooms at $1,500 to $2,200 a month and 5% to 7% gross. This unit’s 7.2% sits just above that because of the existing lease.

Gross vs Net Yield: The Real Numbers

Gross yield is simple: $2,100 × 12 = $25,200 a year, or 7.2% of $350,000. Net yield is what you keep. The worked example below uses assumptions for the HOA fee and the maintenance reserve; replace them with the building’s actual figures before you decide.

Line item Basis Per year
Rent $2,100 × 12 $25,200
Property tax Law 66 of 2017 non-primary rates on a $350,000 registered value −$2,120
HOA fee Assumed $300 a month; confirm with the building administration −$3,600
Property management 10% of rent (typical range 8% to 12%) −$2,520
Insurance and maintenance reserve Assumption −$1,000
Net operating income $15,960
Net yield on the purchase price 4.6%

How sensitive is that figure?

  • Self-managed, with a $200 monthly HOA fee: net yield rises to about 5.6%.
  • Professionally managed, with a $400 monthly HOA fee: net yield falls to about 4.2%.
  • One empty month at renewal: costs about 0.6 percentage points that year.
  • Re-let at $2,300 a month: gross yield rises to about 7.9%.

Property tax

Under Law 66 of 2017, property that is not your registered primary residence pays nothing on the first $30,000 of registered value, 0.6% up to $250,000, 0.8% up to $500,000 and 1% above that (Kraemer & Kraemer). On $350,000 that comes to $2,120 a year. Primary-residence rates are lower but apply to a home you live in. The registered value and any exemption still running show in the registry and tax records, so check them rather than assume. Our guides to Panama property taxes for foreign buyers and the new-construction tax exemption explain both.

Income tax on the rent

Rent from a Panama property is Panama-source income. Individuals pay 0% on the first $11,000 of taxable income, 15% up to $50,000 and 25% above that (PwC). How expenses are deducted and who files depends on how you own the property, so work with a local accountant. US owners also have reporting duties at home, covered in our FBAR and FATCA guide for Panama property owners.

Add purchase costs to your base as well. Our Panama property closing costs breakdown and the guide to notary and lawyer fees list what to budget.

Plan for April 1, 2027 Before You Buy

“Income from day one” is true, but the lease is short. As of late October 2026 it has about five months to run, and a purchase typically takes 30 to 60 days to close, so a new owner might collect two to four months of rent before the expiry date. The renewal decision matters more than the lease itself.

  1. Renew with the current tenant. The lowest-cost outcome. Ask early whether the tenant wants to stay, and use 2026 asking rents of $2,000 to $2,450 to frame a rent review.
  2. Re-let to a new tenant. Budget for an empty month and a letting fee. Costa del Este’s corporate and family demand supports annual leases.
  3. Use the apartment yourself. Possible, but check with your lawyer how the notice rules apply to this contract before relying on it.

Before signing, ask for the tenant’s payment history, whether the rent covers furniture or appliances, and who pays the utilities.

Due Diligence Checklist for a Tenanted Apartment

  • Title. Confirm the finca number, the registered owner and any mortgage or lien at the Public Registry. Our foreign property ownership guide explains the process, and title insurance adds a further layer of protection.
  • Lease file. The signed contract, proof it was lodged with MIVIOT, the deposit receipt and a rent ledger.
  • Condominium (PH) documents. The building regulations, the current HOA fee, any special assessments and the HOA’s paz y salvo (clearance letter). The regulations also decide whether short-term letting is allowed; see our guide to Airbnb and short-term rental rules in Panama City.
  • Property tax clearance. Panama owners often settle property tax only when they sell, so make sure the seller’s tax paz y salvo is in the closing file.
  • Parking and storage. Confirm which parking spaces and storage, if any, are included in the deed.
  • Who pays which tax. By convention the seller pays the 2% transfer tax and the 3% capital gains advance, each calculated on the higher of the price or the registered value (PwC). Terms can be negotiated, so write them into the promise to purchase. Your own exit costs are explained in our guide to capital gains tax on Panama real estate sales.
  • Funds and ownership structure. Decide whether to buy in your own name or through a company before you sign. Our guides to opening a Panama bank account as a property buyer and holding property through a Panama company cover both.

Residency: Friendly Nations Yes, Qualified Investor No

  • Friendly Nations Visa. Citizens of eligible countries can qualify through a real estate purchase of at least $200,000, starting with two years of temporary residency before permanent status. At $350,000 this unit clears the minimum. Our Friendly Nations Visa 2026 guide explains the process.
  • Qualified Investor Visa. Executive Decree 17 of 8 September 2026 split the real estate route in two: $300,000 for a new, unoccupied unit bought from the developer, and $500,000 for property that has previously been sold, occupied or leased (Pacífica Legal). A resale unit with a tenant falls in the $500,000 tier, so this apartment would not qualify on its own. Investments or contracts perfected before 16 September 2026 may still use the old thresholds if the application is filed within six months.
  • Pensionado Visa. Based on pension income rather than property value; see our Pensionado Visa guide.

Panama changes immigration rules by executive decree, so confirm your route with an immigration lawyer before you buy.

Who This Purchase Suits

It suits investors who want long-term rental income without furnishing a unit or finding a tenant, Friendly Nations applicants who want their qualifying property to earn income, and buyers planning to move to Panama later who want the apartment rented until they arrive.

It suits less well buyers who need the apartment empty soon, Qualified Investor applicants with a budget under $500,000, who should look at new first-sale units instead, and short-term rental investors, unless the building’s rules allow it. If you would rather start without a tenant, compare current Costa del Este listings, such as a two-bedroom residence in Arcadia or the new Generation Tower condo suites.

Frequently Asked Questions

1. Can I buy an apartment in Panama that already has a tenant?

Yes. Under Law 93 of 1973, the buyer must respect the existing lease, so the tenant stays and pays rent to the new owner.

2. Does a lease end when the property is sold in Panama?

No. The sale does not end the lease. It continues on its agreed terms until it expires or is ended under the lease law.

3. Who holds the tenant’s security deposit?

The deposit, equal to one month’s rent, is consigned to MIVIOT’s Dirección General de Arrendamientos rather than kept by the landlord. Confirm it was lodged before you close.

4. What yield does The Regent apartment produce?

At $2,100 a month on $350,000, the gross yield is 7.2%. Under the assumptions in our worked example, the net yield is about 4.6% before income tax.

5. How much property tax will I pay on a $350,000 rental apartment?

About $2,120 a year at the non-primary rates in Law 66 of 2017, if the registered value equals the price and no exemption applies.

6. Does this apartment qualify me for Panama residency?

It meets the $200,000 real estate minimum for the Friendly Nations Visa. It does not meet the Qualified Investor route, which now requires $500,000 for resale or previously leased property.

7. Can foreigners buy property in Costa del Este?

Yes. Foreigners can own titled property in Panama with the same rights as citizens. Our guide to buying property in Panama as a foreigner explains the steps.

8. Can I rent The Regent apartment on Airbnb?

Only if the building’s regulations allow short-term rentals. Check the PH rules before you buy.
